Terms and Conditions

Please read the following carefully. By accessing this website and/or placing an order, you agree to be bound by our Terms and Conditions as detailed below:

Placing Orders with SPHICGGA

Orders can be placed via this website 24 hours a day, 7 days a week.

When an order is placed you are offering to buy the selected item for the price stated on our website at the date of purchase, subject to these Terms.

When you place your Order online you will be sent an email to confirm that we have received it. This email confirmation will be produced automatically so that you have confirmation of your Order details. The fact that you receive an automatic confirmation does not necessarily mean that we will be able to meet your Order. Once we have sent the confirmation email we will then check availability and contact you with a further email. If the Product is available and the details of the Order are correct, this email will be deemed an acceptance and will specify delivery details and confirm the price of the Products purchased. If the Product is not available we will also let you know by email together with an estimated time for the Products availability.

For your records, please print and retain a hard copy of the transaction receipt that will be sent to you via email.

SPHICGGA Ltd has the right to cancel any sale if it is reasonable to do so and may change or discontinue the availability of products at any time at its sole discretion. If an Order is cancelled, any payment made for the Products will be refunded in full. This does not affect your Statutory Rights.

If you place your order, and for whatever reason change your mind and wish to cancel straight away, please notify us within 1 hour by email (info@sphicgga.com), to ensure your order is not dispatched.

Price

You will be notified of the delivery costs automatically before you submit your credit card details, based on the delivery address you specify. For more information about our delivery charges click here.

All prices are inclusive of VAT.

Prices quoted on SPHICGGA.com are in UK pounds (£ Sterling). If you are ordering from outside the UK your credit card company should exchange the amount charged to the currency of your country at the current rate. Please note that both charges and refunds are in UK pounds and SPHICGGA Ltd cannot be held responsible for any loss due to exchange rate fluctuations.

Non-EU customers are responsible for Import Duty/Tax in their respective countries and you will be solely responsible for all such costs. Unfortunately we cannot advise you what these costs will be - please consult your local customs office for more information.

Payment

Payment for your Order must be received before it is dispatched. Where an Order consists of a number of Products SPHICGGA Limited will have no obligation to meet such Order until payment for the total amount due under the relevant Order has been received in full.

Please note we only accept payment in £GBP Sterling.

Orders may be processed online using a credit or debit card (currently VISA, MasterCard, Visa Delta, Switch, Solo and Maestro). Once SPHICGGA Ltd has received your purchase request we will begin to process your order. Please be aware that full payment will be taken from your card when we have accepted your order and it is ready to be dispatched. The due date for payment is the date that we receive your order.

If you fail to make full payment for an order on the due date for payment you shall be liable to pay interest on all sums due at a rate of 4% above the base rate from time to time of NATWEST Bank PLC such interest accruing on a daily basis until payment in full is received.

Purchases will appear on your statement as 'SPHICGGA LTD'.

To ensure that shopping online is secure, your credit/debit card details will be encrypted to minimise the possibility of someone being able to read them as they are sent over the Internet.

Your credit card company may also do security checks to confirm it is you making the Order.

All Order details and invoices will be sent to the credit card billing address and not the delivery address where the named recipient of the Order differs.

Availability

SPHICGGA.com is kept as up to date as possible but we cannot guarantee that a particular Product will always be available. If we can't supply a Product [within 30 days] you will not be charged for it and we will refund or re-credit your account with the amount debited by us.

All offers are available while stocks last. If we have not supplied a Product you have Ordered within [30] days, you may cancel your Order and we will refund you the money you have paid.

Marketing Communications

If you have used the SPHICGGA.com web site before or have Ordered Products from us before it is possible that we have some information already and it is being used to contact you about offers, events, items or related activities that you may find useful. If you are an existing customer we will continue to keep you informed unless you tell us not to.

If you are a new customer we will give you the choice (once you have placed an Order) whether or not you want us to contact you about future offers, events and new Products or related activities that you may find useful and to keep you informed of any changes at SPHICGGA.com.

We will not send you any marketing emails unless you give us your consent, or unless we have it already.

Refunds and Returns

We believe that you will be delighted with your product but there may be occasions where you feel it necessary to return an item. We aim to keep the process as simple as possible. These terms do not affect your statutory rights.

Size Change

When trying on the clothes you feel that the size is not right, we will change it free of charge or provide a full refund as appropriate, if you return the product to us at the postal address below within 14 days of receipt.

In these circumstances we will also pay you the cost of the return postage. Please obtain a proof of posting certificate from your Post Office to enable us to process the refund for your return postage costs.

This does not affect your Statutory Rights.

Unwanted Products

If for whatever reason you are unhappy with an item when you receive it or if you simply change your mind please return it to us within 14 days of posting by us of the Order to you, with the despatch note, and we will refund you the price you paid for that product (excluding P&P). Please note - it is the responsibility of the customer to take reasonable care of the product(s) during this period, and to return them in a new and unused state.

We will make the refund directly to the credit/charge card used to place the original order within 30 days of the cancellation and you will only have to pay for the return postage of the Products.

No refund will be made in respect of Returned items which are not in a new and unused condition when received by us, or which are received after the period of 14 days of the posting of the Order by us to you, unless they are faulty

Faulty Products

We try to select and package the Products as well as possible to ensure they arrive in tip top condition. However, if a Product arrives damaged or is not what you ordered, we will replace it free of charge or provide a full refund as appropriate, if you return the product to us at the postal address below within 14 days of receipt.

This does not affect your Statutory Rights.

Returning Unwanted or Faulty Products

Please contact us by email (at info@SPHICGGA.com) to inform us of your wish to return Products.

We may allocate you with a Returns Code which should be included with the package to improve processing of your return.

Risk and Title

All risks, damage or loss to Goods shall pass to the Customer on delivery. In the event that the Customer fails to take delivery without good reason risk in the Goods shall also be deemed to have been passed to the Customer at the time of attempted delivery. The Customer must ensure that the Goods will be stored at a dry and secure location

Notwithstanding delivery or any other provision of these Conditions, the title and ownership in the Goods shall not pass to the Customer until the Company has received in cash or cleared funds payment in full of the Price. Until ownership has passed the Customer shall hold the Goods on a fiduciary basis as the Company's bailee and must maintain the Goods in satisfactory condition and keep them insured on the Company's behalf

You will be responsible for the returned products until they reach us so please use a secure delivery method which requires a signature upon receipt (such as via Royal Mail First Class Recorded Delivery) and return to the address below.

PLEASE NOTE, WE (SPHICGGA LTD) RESERVE THE RIGHT TO CHANGE, MODIFY, ADD OR REMOVE PARTS OF THESE TERMS AND CONDITIONS AT ANY TIME. PLEASE CHECK THESE CONDITIONS PERIODICALLY FOR ANY CHANGES.

SPHICGGA Ltd does not give you any right or interest in any copyright or intellectual property rights in any Product nor the right to copy them.
The copyright in SPHICGGA.com and the content of all the software, web site and pages relating to the SPHICGGA.com web site is owned by, or licensed to SPHICGGA Ltd, unless otherwise specified and may not be used, copied or altered without our express consent.
Copyright extends to the design, look and feel of SPHICGGA.com, all Pictures, photographs on it and its marketing materials.
You may use SPHICGGA.com for private and personal non-commercial use only - i.e. to view, copy and print portions of SPHICGGA.com for the sole purpose of placing Orders. The materials on SPHICGGA.com may not be used for any other purpose without prior consent.

Privacy Policy

At SPHICGGA we make a commitment to protect your privacy and promise only to use information collected about you in accordance with the Data Protection Act 1998.

When you place an order, we may ask you to submit certain information and personal data to SPHICGGA.com (for example your name, phone number, postal address, email address, contact and bank / credit card details). We may also record which products you are interested in and which products you purchase as well as customer traffic patterns and site use.

This information will be kept securely in accordance with our internal security policy and may be used to:

- provide you with an up to date, efficient, and reliable service;

By making an Order and submitting your data you agree to this use.

Order Delivery and Dispatch

SPHICGGA currently delivers to destinations worldwide via the following services:

Standard Delivery

- Free Delivery for orders over - £100 (applicable to UK mainland only)
- Orders within the UK - £3.95 (1-3 working days depending on location)
- Orders to Europe - £9.95 (3-5 working days depending on location)
- Orders to Rest of World - £15.95 (5-10 working days depending on location).

You will be notified of the delivery costs automatically before you submit your credit card details.

Next Working Day Delivery (UK Only)

- Orders to the value of £49.99 and under - £6.95
- Orders to the value of £50.00 and over - £9.95

Orders placed before 1pm (Mon- Fri) are despatched the same day, for next day delivery via Next Working Day Special Delivery, subject to stock availability and security checks.

Please be aware that our Special Delivery Option guarantees next working day delivery for orders placed before 1pm (Mon- Fri). On Fridays 'Next Day' means Monday.

Sometimes delivery can take longer than anticipated due to unforeseen circumstances. If this does occur, SPHICGGA Ltd will work our couriers to get your order to you asap, however we cannot be held responsible for any financial loss due to late deliveries. To avoid such occurrences, we recommend using our Guaranteed Next Working Day delivery option.

The delivery costs detailed are PER ORDER, so you can order a much as you like at the same time and the delivery charge will remain the same.

All orders are dispatched within 48 hours if the product(s) is available. You will be sent a confirmation email as soon as your order is dispatched, so you know when to expect delivery of your order.

In the event of the product(s) you have ordered being temporarily out of stock, we will email you to let you know the estimated date of dispatch. At this stage, it will be possible to cancel your order if the delivery date is unsuitable.

Delivery outside the EU may be subject to local import taxes, which are your responsibility where they apply. Unfortunately we cannot advise you what these charges will be and SPHICGGA LTD is not responsible for them.

Orders are dispatched by Royal Mail (1st Class) and Parcel Force within the UK. All orders outside the UK are dispatched by Royal Mail Airmail and the Local Postal service of the destination country.

We will make every effort to deliver within the time stated on SPHICGGA.com but we will not be liable for any loss caused to you by late delivery.

If the Products are not delivered within the estimated delivery time which we quote, please contact us by telephone or email and we will try and ensure that you receive your Order, as quickly as possible, or if you wish you may cancel your Order and we will refund the money you have paid.
